Food Not Bombs Roswell Gains Protections for Its Expressive Activity and Public Assembly
Today, Food Not Bombs Roswell (FNBR) announced it has settled its freedom of expression and public assembly lawsuit against the City of Roswell, New Mexico.
As part of the settlement, the City of Roswell agreed that Pioneer Plaza is a “traditional public forum,” a designation that carries some of the strongest free speech and public assembly protections under the law. The City of Roswell also agreed that the public ordinance they had previously applied to restrict FNBR’s food sharing does not apply to the organization’s activities, and that FNBR will be allowed to return to Pioneer Plaza without a permit.
1A Santa Fe congratulates FNBR on its successful effort to bring the City of Roswell into compliance with the New Mexico and United States Constitutions, as well as judicial precedent protecting the free expression and public assembly rights of all New Mexicans.
